Copyright & DMCA Policy

BeatCheck respects the intellectual property rights of others and expects users of our platform to do the same. We respond to notices of alleged copyright infringement that comply with applicable law, including the United States Digital Millennium Copyright Act (DMCA) and the UK Electronic Commerce (EC Directive) Regulations 2002.

How to submit a takedown notice

If you believe that content hosted on BeatCheck infringes your copyright, please send a written notice to our designated agent at copyright@beatcheck.app. Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or an authorised representative.
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is acceptable.
  3. Identification of the material that you claim is infringing, with sufficient detail for us to locate it (e.g. the release URL or title on BeatCheck).
  4. Your contact information: name, mailing address, telephone, and email.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.

Notices that are incomplete or that do not comply with the above requirements will not be actioned. Knowingly submitting a false notice may expose you to liability under 17 U.S.C. § 512(f) (US) or equivalent legislation in your jurisdiction.

Counter-notice procedure

If you believe your content was removed in error, you may send a counter-notice to copyright@beatcheck.app. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the US, any judicial district in which BeatCheck may be found), and that you will accept service of process from the person who provided the original notice.

Upon receipt of a valid counter-notice, we will provide a copy to the original complainant and may restore the removed content after 10–14 business days unless the complainant files a court action.

Repeat-infringer policy

BeatCheck will terminate the accounts of users who are found to be repeat infringers. We define a repeat infringer as any user who has received two or more valid DMCA takedown notices relating to content they have uploaded or distributed through the platform. Account termination may be imposed after the first notice in egregious cases (e.g. deliberate, large-scale infringement).
